These Terms of Use apply to everyone who uses Avacone Planner (the "Planner"), the internal tool for time off, rotas and related staff records of Avacone Romania S.R.L. ("Avacone", "we"). By signing in and using the Planner you accept these Terms. If you don't accept them, don't use the Planner and contact info@avacone.com.
1. Who provides the Planner
- Operator: Avacone Romania S.R.L., Bdul. Nicolae Titulescu 4, Et. MEZ, Ap. XIV/A, Cluj-Napoca, Județ Cluj, Romania, Trade Register J2021003530123, CUI 44632114. Avacone runs the Planner for its staff and decides how it is used.
- Software: the Planner was developed by and is the property of Web Runner S.R.L. (Str. Eroilor 196, Ap. 11, Sat Florești, Județ Cluj 407280, Romania, Trade Register J2025025706003, CUI 51609874), which licenses it to Avacone and maintains it.
2. Who may use it
The Planner is for Avacone's employees and contractors who have been given an account. Accounts are personal: keep your password secret, don't share your account, and sign out on shared devices. Tell your administrator straight away if you think someone else used your account.
3. What the Planner is for
You can use the Planner to request and manage time off, see your shifts and your team's availability, and - depending on your role - approve requests, plan rotas and run reports. Balances, approvals and attendance records in the Planner support, but do not replace, your employment contract, Avacone's internal policies and the Romanian Labour Code. If something looks wrong, tell your manager or HR.
4. Acceptable use
When using the Planner you agree not to:
- access accounts, data or features you are not authorised to use, or try to get around security or permissions;
- enter information you know is false, or upload anything unlawful, offensive or not related to your work (supporting documents should contain only what is needed, e.g. a medical certificate);
- upload malware, overload the service, or use automated tools to scrape or copy it;
- copy, modify, reverse engineer or redistribute the software, except where the law allows it;
- share other people's personal data from the Planner outside the purposes it is meant for.
Avacone may investigate misuse and act under its internal rules and the law.
5. Your data
Avacone is the controller of the personal data in the Planner. How it is used, who can see it and your rights are explained in the Privacy Policy. The cookies the Planner uses are listed in the Cookie Policy.
6. Availability and changes
We aim to keep the Planner available and accurate, but it may be interrupted for maintenance, updates or reasons outside our control, and it is provided without guarantees of uninterrupted or error-free operation. Features may change. If these Terms change in substance, the Planner will ask you to acknowledge the new version.
7. Intellectual property
The Planner software and its design belong to Web Runner S.R.L.. Avacone's name, logo and content belong to Avacone. Using the Planner gives you no rights in either beyond using it for your work at Avacone. Open-source components included in the software remain under their own licences.
8. Ending access
Your access ends when your work relationship with Avacone ends, or earlier if Avacone or its administrators decide so (for example for misuse or security reasons). Access can also end if the software licence between Web Runner S.R.L. and Avacone ends. Records about you are kept as described in the Privacy Policy, also after your access ends.
9. Liability
To the extent permitted by law, neither Avacone nor Web Runner S.R.L. is liable for indirect loss arising from the use of, or inability to use, the Planner. Nothing in these Terms limits liability that cannot be limited under Romanian law, including for intentional acts or gross negligence, or your rights as an employee.
10. Law and disputes
These Terms are governed by Romanian law. Disputes are to be settled amicably where possible and otherwise by the competent courts of Cluj-Napoca, Romania, without prejudice to any mandatory rights you have as an employee.
